The defendant sought to dismiss these claims for delay, while the plaintiff sought summary judgment, asserting that the defendant had no defense.


In determining the delay application, the court emphasized the importance of a fair trial and the potential prejudice to the defendant due to the delay. The court found that the delay in the plaintiff's claims was largely inexcusable and dismissed the claim for unpaid purchase money due to the significant prejudice to the defendant.


However, the court allowed the claims for unpaid rent and personal services to proceed to trial, noting that the delay was less prejudicial and that a trial judge could address any issues arising from the delay. The court also refused the plaintiff's application for summary judgment, finding that there were arguable defenses to the claims that required a plenary hearing.
